According to the Atlanta Black Star, Treasure Price has threatened to sue Atlanta police after she sustained injuries in a DUI arrest. The “Love and Hip Hop: Atlanta” star was pulled over after she ran a red light earlier in December. The arresting officers claim that they administered a field sobriety test and that Price failed. As a result, she was arrested for failure to obey, reckless driving, and DUI. Now, however, she is threatening to sue the Atlanta police for injuries she sustained during the arrest.
Price told news outlets that on the way to the police station, the cops slammed on their brakes to avoid hitting a pedestrian. The abrupt stop caused her to slide around in the backseat because the arresting officer failed to strap her into a seat belt. Price alleges that the cop’s indiscretion directly led to her face being smashed into the metal cage in the backseat of the patrol car. She sustained bruises and injuries to her face, nose, cheek, and chest, as well as whiplash.
When Arresting Officers Violate Rights
Whether or not the arresting officers violated Treasure Price’s rights or were negligent in their arrest remains to be seen. However, violations of rights during a DUI arrest are not uncommon. Even individuals accused of committing crimes have constitutionally protected rights, including:
- The right to remain silent
- The right to have an attorney present
- The right not to be asked questions until your attorney is present
- The right to refuse a DUI test (although that has penalties)
- The right to request a specific BAC test
- The right to have that BAC test administered by a qualified healthcare professional
- The right to be treated humanely
- The right not be held unfairly without being charged with a crime
- The right to a speedy trial
- The right to protest an illegal search and seizure
- The right to contest the revocation of your driver’s license
Unfortunately, just because you have certain constitutional rights, doesn’t mean there aren’t consequences for exercising these rights. For example, while you have a right to refuse a DUI test, this will come with an automatic assumption of guilt and the loss of your driver’s license for one full year.
